This form is operated by HarperCollins Publishers Limited (“us”/“we”/”our”). We are committed to protecting your privacy and we are the controller and are responsible for your personal information. Our Privacy Policy should be read in conjunction with the Terms and Conditions of use for www.lovehopeloss.co.uk (the “Website”) of which it forms part.
Permission from Contributor for HarperCollins and Audrey Ward to assess the Content for inclusion in the Book
- By submitting content (“Content”) to HarperCollins and the Author via the Website , you (“You” /”Contributor”) hereby grant to HarperCollins Publishers Limited and their affiliates (“”HarperCollins”) and Audrey Ward (the “Author”), the right to assess your submission (“Contribution”) to be included in the book with a working title of The Waiting Room (“Book”) to be published by Us.
- HarperCollins and the Author do not guarantee that your Contribution will be included in the Book. You will be notified separately if your submission is successful and will be included in the Book and will be require to sign a Contributor Release Form. Most submissions will be kept anonymous and if we want to remove anonymity, this will be subject to your consent.
- If HarperCollins and the Author decide to include your Contribution in the Book, You will receive a copy of the Book as consideration for including the Contribution and agreeing that:
- all copyright and any and all other rights, including but not limited to moral rights, to which You are entitled in any media of expression in the Contribution and the Book are assigned absolutely to, and shall be the property of the Author throughout the world in perpetuity including any extensions, renewals or revivals thereof. All media shall include but not be limited to television, video, publishing, e-books, audiobooks, internet, merchandising and computer software;
- HarperCollins and the Author are not required to credit You in relation to the Book;
- You are not entitled to any royalties or any other financial rewards from the sale of the Book.
- HarperCollins and the Author shall not be liable for any claims of defamation, invasion of privacy and/or data protection as a result of the use of the Contribution in the Book.
- HarperCollins and the Author shall not be liable for any claims, expenses, losses (indirect or consequential loss), damage (direct or indirect) howsoever caused that arise from performance and/or non-performance of this Agreement except that nothing in this Agreement shall exclude or limit any liability for death or personal injury arising from negligence or any other acts or omissions the exclusion or limitation of which is prohibited by law and You guarantee to keep Us, our successors, assigns and licensees at all times fully covered for all expenses resulting from and against all actions, proceedings, claims, demands, costs and damages however arising directly or indirectly of your breach of this Agreement.
- You warrant and represent to Us that:
- You are aged 18 or over;
- the Contribution is original to You;
- the Contribution does not infringe any existing copyright or similar right of any third party nor contains anything defamatory, obscene or otherwise unlawful;
- the Contribution does not breach any confidence or invade the privacy or infringe the data protection rights of any person and is not in breach of the Official Secrets Act or similar legislation;
- the Contribution is not, and has not been, the subject of any complaint, claim or legal proceedings (actual or threatened).
- You also grant HarperCollins and the Author the right to contact you directly to discuss matters attendant on the editorial development or publication of the Content.
- Your personal data will be processed solely for the purpose of assessing and, if applicable, including the Contribution in the Book.
- You acknowledge that the Book may be published in multiple territories other than the UK.
- These terms and conditions shall be governed by the laws of England and Wales and is subject to the exclusive jurisdiction of the English courts.
